Children’s seat shell
§ 6 # 361/2000 Sb. Obligations for drivers of motor vehicles.
§6 (1) The driver of motor vehicle is apart from obligations stated in §4 & 5 obliged to:
a) have seatbelts fastened if seat is equiped by such according to a special legal entactment [2],
b) not transport in vehicles of categories M1, N1, N2 or N3 [2], which are not equiped by a retaining safety system,
1. child younger than 3 years of age
2. child smaller than 150cm in height on the seat next to the driver
c) not transport in vehicles of categories M1, N1, N2 or N3 [2], which are equiped by a retaining safety system, a child, who’s weight is less than 36kg and height is less than 150cm, only when using children’s safety shell; during this transport
1. the child must be placed in the safety shell, which corresponds to its weight and physical proportions
2. on seat, which is equiped by an airbag, which has not been placed out of order, or if it was placed out of order automatically, the child in a safety shell must not be placed facing against the driving direction
d) place and fasten the safety shell on a seat and put a child into the shell according to terms stated by the producer of the shell in the directions for use of the shell,
e) transport in vehicles of categories M1, N1, N2 or N3 [2], which are equiped by a retaining safety system, a child, who’s weight is more than 36kg and height is more than 150cm, only when there is a seat belt fastened around the child
f) transport in vehicles of categories M1 & N1[2], which are equiped by a retaining safety system and in which there are already two safety shells placed on the back seats and lack of space disables the driver to place a third safety shell, third child older than 3 years of age and with height lower than 150cm on the back seat only if there is a seat belt fastened around this child
g) give instructions to all persons older than 3 years of age or persons accompanying these in vehicles of categories M2 & M3[2], which are equiped by a retaining safety system, about an obligation to use a retaining safety system, in case this information is not passed along differently
h) while driving a motorcycle or moped, have placed and throughly fastened a safety helmet of an accredited type according to a special legal entactment [2] and shelter one’s sight reasonably, for example by glasses or a shield, if these do not lower thr transport safety during train or snowing
§6 (4) Regulation by virtue of paragraph 1, letter c) does not apply for transporting children in town in a taxi car while delivering a taxi service; a child in letter c) must not be transporting on a seat next to the driver and there must be a seat belt fastened around it. Should there be a children’s safety shell in use during the transport, a requirement stated in paragraph 1 letter c) article 2 must be fulfilled.
